On February 12, 2021, lawyers from Kaplan Hecker & Fink LLP, along with co-counsel at Public Rights Project, filed an amicus brief at the U.S. Supreme Court in Cedar Point Nursery v. Hassid, a case involving a Takings Clause challenge to a California agricultural labor regulation. The brief, filed on behalf of the City of Seattle (joined by local government across the country), explains that the petitioners’ characterization of the regulation as effecting a per se taking conflicts with the Court’s well-established takings jurisprudence and threatens a vast array of local laws that protect our health, safety, and welfare.
