On January 3, 2023, Kaplan Hecker & Fink attorneys, along with co-counsel at the Georgetown University Law Center’s Appellate Courts Immersion Clinic, secured an important victory on behalf of their client Magan Wallace in Wallace v. Performance Contractors, Incorporated, No. 21-30482, an employment discrimination case in the United States Court of Appeals for the Fifth Circuit.  Wallace was the only female “Helper” in her two-hundred person unit at a major construction site in Louisiana.  She was denied the ability to work at elevation and gain valuable experience and training based on her sex and was subjected to an environment of discriminatory and inappropriate conduct and statements.  In a unanimous decision, the Court reversed the district court’s grant of summary judgment and reinstated Wallace’s claims for sex discrimination, sexual harassment, and retaliation.
