Joshua Matz, Larry Tribe, and Amit Jain co-authored an analysis published by Just Security titled, “Why and How the Senate Should Swiftly Dismiss the Impeachment Charges Against Mayorkas.”

By a vote of 214 to 213, the House of Representatives approved two articles of impeachment against Homeland Security Secretary Alejandro Mayorkas on February 13, 2024. The authors argue that “impeachment is reserved for great and dangerous offenses against the nation; it is not a tool for a House majority to secure free publicity for policy attacks on an administration.” They offer several options for the Senate to consider in disposing of the Mayorkas impeachment, including a motion to dismiss the charges, resolving the matter through a point of order, or a special committee to handle trial proceedings.
