Kaplan Hecker & Fink LLP filed an amicus brief in the D.C. Circuit in P.J.E.S. v. Wolf et al.­­—a lawsuit challenging the Trump administration’s unprecedented invocation of the Public Health Service Act (42 U.S.C. §265) to expel unaccompanied noncitizen children at the border under the guise of protecting public health. After the district court granted a preliminary injunction ordering the Government to cease deporting children under this new policy, the Government filed a motion for a stay in the D.C. Circuit. The firm represents leading historians in urging the D.C. Circuit to deny the Government's request to stay the district court’s injunction. As the amicus brief explains, the Government’s invocation of 42 U.S.C. §265 to deport immigrant children ignores the statute’s text and the historical context in which it was enacted.
