On January 3, 2024, Kaplan Hecker & Fink LLP filed an amicus brief in the U.S. Supreme Court on behalf of the National Association of Criminal Defense Lawyers (NACDL) in support of the Petitioner in Delilah Guadalupe Diaz v. United States of America (No. 23-14).

In this case, the Supreme Court will decide whether law enforcement officers—functioning as expert witnesses in drug trafficking cases—can testify that most defendants caught with drugs at the border know that they are transporting drugs. KHF’s brief urges the Supreme Court to hold that expert testimony from law enforcement officers on such classwide mens rea has no rightful place in our administration of criminal justice.
